The facts

The complainant alleged three cameras set up by a neighbour, including one in a side alley that flashed on movement, were capturing footage from his premises. At a first police visit the respondent declined to show the CCTV images and was asked to reposition the cameras; the Office then asked the Police to pursue a warrant of entry and search from a District Magistrate. A second site visit found the cameras had already been adjusted and no DVR was present.

Orders and outcome

The Data Protection Commissioner closed the enquiry to the satisfaction of all parties under the closure provision of the Data Protection Act.
