The facts

The complainant, who shares a two-floor split house with the respondent's family, alleged a camera in the communal area pointed at his bedroom, balcony, part of the living room and the shared pathway, was installed without consent, triggered a loud continuous sound and a blinding light, and stood about twelve feet from the bedroom. The Police found the contested camera had been lowered on its pole, the footage on the respondent's phone covered only the respondent's yard and ground floor, and a second report determined all the respondent's cameras were out of order with damaged and disconnected cables.

Orders and outcome

The Commissioner closed the enquiry to the satisfaction of all parties, finding that no breach of the Data Protection Act had occurred.
