The facts

A residential co-ownership's property management complained that the respondent's CCTV camera captured the public road serving as the only access to the development, with residents, visitors and employees reporting they were being observed; some employees said the respondent commented on their recorded movements, which they took as harassment, and there were fears the continuously recorded footage might be shared abroad. A Police site visit found the cameras were not capturing inside the complainant's premises. The complainant objected to closure, citing a flash from the camera, and asked for access to footage and a deeper inquiry; the respondent's written statement and evidence again showed no capture inside the complainant's premises.

Orders and outcome

The Data Protection Commissioner closed the enquiry to the satisfaction of all parties under the DPA.
