The facts

The complainant alleged that his neighbour had installed a rotating, motion-detecting CCTV camera with a long-distance view pointed directly at his premises, capturing his movements and any visitors. The Data Protection Office asked the Police to investigate and conduct a site visit. The Police reported that the camera was connected to a mobile phone rather than a DVR, captured no images inside the complainant's premises, was installed for security, and disclosed no evidence prejudicial to the complainant.

Orders and outcome

The Data Protection Commissioner decided that the enquiry had not disclosed the commission of an offence under the DPA and closed it to the satisfaction of all parties.
