The facts

The complainant alleged that his neighbour installed a CCTV camera near the boundary wall separating their premises, from which the respondent could spy on him and deprive him of privacy in his own house. The office conducted a balancing exercise between the data subject's rights and the camera operator's legitimate interests, and observed from the outset of the enquiry that the cameras were not capturing the complainant's premises.

Orders and outcome

The Data Protection Commissioner found no breach of the Data Protection Act committed.
