Anonymised respondent
Enquiry closed for lack of complainant collaboration. DPO, 20 August 2015.
The facts
An ex-employee complained on 20 August 2015 that her former employer kept displaying her photograph, taken to show the organisation's cultural diversity, on a customer feedback device at its reception desk after her employment ended, and demanded deletion plus Rs 50,000 in compensation. The Office informed her it has no power to award damages, which require a civil case, and asked her to lodge an official complaint form. Despite reminders she did not pursue the complaint. The respondent stated the image had been used with consent and confirmed it had removed her picture from the device at her request.
Orders and outcome
The enquiry was closed for lack of collaboration from the complainant, the respondent's cooperation having already led to removal of the picture from public viewing.
