The facts
Two ex-employees complained on 17 June 2015 that security guards photographed them without permission. The company and its staff explained that the photographs were taken on a dump yard that is a restricted, signposted area, that the site camera was not operational so guards were authorised to photograph incidents as proof to management, and that the images were used solely as evidence of unauthorised access before a disciplinary committee.
Orders and outcome
The Commissioner held that the photographs were justified by management for the disciplinary process and found no offence under the Data Protection Act.
