The facts
The complainant alleged that Platinum Credit Limited, directly or through its sales agents, constantly sent him unsolicited text messages and calls promoting its loan products without his knowledge or authorisation. The ODPC found the respondent liable, and further found that by furnishing the Data Commissioner with information it knew to be false or misleading, the respondent committed an offence under the Act.
Orders and outcome
The respondent was found liable and ordered to pay the complainant Kenya Shillings Four Hundred Thousand (KES 400,000) as compensation. An enforcement notice was issued, and the Office recommended the prosecution of the respondent's directors for furnishing the Data Commissioner with information they knew to be false or misleading.
