The facts

The complainant stated that from 1 March 2024 Mulla Pride Limited constantly harassed and threatened him by phone over a loan he was not party to, although he had never given the company his contacts. The ODPC found the respondent violated his right to be informed, noted it derailed investigations, and recorded that it is a repeat offender that had deliberately obstructed investigations into a similar complaint.

Orders and outcome

The respondent was found liable and ordered to pay the complainant KES 250,000 as compensation, an enforcement notice was issued, and a recommendation for prosecution was made against the company's directors for obstruction of the Data Commissioner. Dated 3 June 2024.
