The facts

The complainant alleged he was receiving insistent calls from Azura Credit Limited demanding payment of a loan taken by one of its customers, a loan he had no prior knowledge of. The ODPC found the respondent violated his right to be informed, and that its intentional failure to avail a representative from its ICT team to facilitate examination of the backend of its loan application obstructed the Data Commissioner.

Orders and outcome

The respondent was found liable, an enforcement notice was issued against it, a recommendation was made for the prosecution of its directors for obstruction of the Data Commissioner, and it was ordered to pay the complainant Kenya Shillings two hundred and fifty thousand (KES 250,000) as compensation. Dated 15 September 2024.
