The facts

The complainant alleged she was receiving incessant calls from Azura Credit Limited about a loan she was not a party to, without having consented to her mobile number being listed as a reference. Investigations found the mobile phone number that contacted her did not belong to the respondent, but the respondent intentionally failed to avail a representative from its ICT team to facilitate examination of the backend of its loan application, obstructing the Data Commissioner.

Orders and outcome

The complaint was dismissed, and a recommendation was made for the prosecution of the respondent company's directors for obstruction of the Data Commissioner. Dated 30 September 2024.
