Summary

An employee was dismissed after refusing to provide her fingerprint for attendance recording. Recalling a 2013 decision then under appeal at the ICT Tribunal and drawing on the EU Article 29 Working Party's Opinion 3/2012 on biometrics, the Commissioner analysed fingerprint attendance systems against the Act and Article 8 ECHR jurisprudence, with a section 20 referral subject to conditions - part of the Office's early, influential biometrics line.
