The facts

An employer complained that a resigning accounts officer had forwarded six payroll spreadsheets from her office email to her personal email address. The enquiry found the office mailbox was also accessible outside the office, the forwarded content was verified by the IT manager and the employer, no improper use was detected, and the employee had used the information only for work purposes.

Orders and outcome

The Commissioner held that no offence had been committed or proven beyond reasonable doubt to warrant prosecution, no bad faith or criminal intent having been detected. Dated 19 July 2012.
