The complainant alleged he was receiving unsolicited promotional messages from Ceres Tech Limited, trading as RocketPesa, without his consent. Investigations found that the mobile phone numbers that contacted him did not belong to the respondent, and the complaint was dismissed. However, the respondent refused to answer questions during investigations despite being notified of a site visit, and did not allow investigating officers to examine the system used to send the promotional messages.
Orders and outcome
The complaint was dismissed, and the Office recommended the prosecution of the respondent company's directors for obstruction of the Data Commissioner. Dated September 2024.
