The facts
A data subject complained that FT Rams Consulting kept sending direct marketing messages despite multiple opt-out requests. The Information Regulator found the company had contravened POPIA's direct marketing provisions and issued its first-ever enforcement notice, ordering the company to immediately stop messaging the data subject, to procure consent through the Regulator's prescribed form, to seek consent only from data subjects who had not previously withheld it, and to compile and submit a database of data subjects who had withheld or not given consent. The company was given 90 days to comply and warned that failure could carry a minimum sentence of 10 years' imprisonment, a fine of R10 million, or both.
Orders and outcome
Enforcement notice issued with the consent-procurement, database and cessation requirements above, compliance due within 90 days. Dated 27 February 2024 per the spine; the alert is of March 2024.
