The facts
Senegal Auchan Store sought CDP authorisation for the Auchan loyalty programme, which collected customer data through a loyalty card and analysed consumption data. The Commission refused authorisation because consent was not freely collected, with pre-ticked boxes on the enrolment form, no precise retention period was defined in the terms of use, and the processing had been put into operation before the CDP's authorisation.
Orders and outcome
The authorisation request was refused. The following quarter the CDP recorded that the suspension of the Sama Kalpe loyalty programme was lifted after the company revised the enrolment form for explicit and free consent, fixed retention periods of two years for consumption data and until termination of membership for identification data, and limited the data collected. Dated 2021.
