Injunction (injonction) following a union complaint and an on-site control mission. CDP, 4 November 2021.
The facts
The electricity workers' union section at the Kounoune power plant complained to the CDP on 21 January 2021 about video surveillance installed at MHI Equipment Services Africa. After the company's explanations, the plenary ordered a verification mission, carried out on 6 July 2021, which found too few information notices for the cameras installed, permanent surveillance of employees in the canteen, control room and workshops, cameras filming changing-room entrances, no information for staff about the new system or their rights, and undeclared processing of employee health data and time records.
Orders and outcome
Meeting on 4 November 2021, the plenary enjoined MESA's management to act within seven days of receiving the decision, including moving or reconfiguring the canteen camera so it does not film during breaks, repositioning the control-room and changing-room cameras, informing staff, and declaring the outstanding processing operations. Dated 4 November 2021.
