The facts

The NDPC fined Fidelity Bank 0.1 percent of its 2023 revenue, 555,800,000 naira, for violating data protection laws in the opening of a customer account, following an investigation that began in April 2023 after a customer complaint. The Commission found that in certain critical cases the bank processed personal data without the informed consent of data subjects and deployed tools such as cookies and banking apps in violation of the law. At the time this was the largest fine the NDPC had imposed. Fidelity denied any breach, said it had not completed the account opening, and stated it remained in discussions with the NDPC over an amicable resolution.

Orders and outcome

The bank was directed to pay 555,800,000 naira within fourteen days. Fidelity Bank stated it was challenging the decision.
