The facts

A customer alleged that the owner of a restaurant used her mobile number for a purpose other than business by sending her defamatory and insulting text messages. The respondent initially denied the allegation, but the text messages the complainant produced showed otherwise; he then admitted sending them following negative reviews, said he was unaware of his obligations under the Data Protection Act, and apologised to the complainant in writing at her request, after which she withdrew the complaint.

Orders and outcome

The Data Protection Commissioner closed the enquiry to the satisfaction of all parties, finding no offence committed under the Data Protection Act.
