Anonymised respondents (2, landlords)
Referred to police for prosecution (s.20). DPO, 10 May 2013.
The facts
Three complaints concerned CCTV cameras at two rented premises. Site visits found that while operational the cameras recorded images beyond the premises, and although the first respondent said recording had stopped and promised to remove the cameras from a premise it had vacated (later rented by the second respondent), no removal was carried out despite ample time, leaving equipment the Office considered a continuing threat to the complainants' privacy.
Orders and outcome
The Commissioner advised prosecution for unauthorised processing of personal information without the data subjects' express consent and referred the matter to the police for proper legal proceedings against both respondents. The document is an undated published summary.
