The facts

An ex-employee was accused of forwarding company emails to himself and of sending two spreadsheets containing personal data of existing and prospective clients to a third-party company without authorisation. The third party confirmed it never requested the spreadsheets. The Commissioner held that although the respondent compiled the sheets during his employment, the information belonged to the employer's business and could not be treated as his personal property to distribute, even in claimed good faith.
