The complainant alleged that Wananchi Group (Kenya) Limited, trading as Zuku Fibre Kenya, failed to delete his personal data despite repeated requests. The ODPC found the respondent liable for violating his right to object and his right to erasure, and further found that the respondent obstructed the Data Commissioner in the exercise of her powers.
Orders and outcome
The respondent was ordered to delete the complainant's personal data from its systems, stop contacting him and provide proof to the Office within 7 days, and to compensate him a total of Kenya Shillings Five Hundred Thousand (KES 500,000). The Office recommended the prosecution of the respondent's directors for obstructing the Data Commissioner. Dated 15 February 2025.
