The facts

The complainant alleged that My Dawa, trading as ION Kenya Ltd, kept sending her promotional messages in disregard of her right to object. The ODPC found the respondent failed to demonstrate a legal basis for processing her personal data or respect for purpose limitation, and that continuing to send promotional messages after her objection was unfair and unlawful processing.

Orders and outcome

The respondent was found liable and an enforcement notice was issued against it, the complainant having prayed for deletion of all her details from the respondent's contacts and database. No compensation was ordered. Dated 2025, with the month partially illegible in the scan.
