The facts

The complainant alleged that Milestone Games Limited, trading as SportPesa, failed to delete his personal data despite numerous requests. The ODPC found the respondent violated his right of erasure and failed to adhere to the data minimisation principle in its account deletion process.

Orders and outcome

The Office declined the KES 1,000,000 the complainant prayed for and ordered the respondent to pay him Kenya Shillings Three Hundred and Fifty Thousand (KES 350,000) as compensation. A recommendation for prosecution was made against the directors of the respondent company for obstruction of the Data Commissioner. Dated 17th of a month in 2025.
