The facts
The complainant alleged that Michael's Bouquet used her image in print media and on public banners for commercial gain without her express consent. The respondent failed, refused or neglected to respond to the notification of complaint and so failed to prove it had obtained express consent for the use of her image on its public social media platforms.
Orders and outcome
The respondent was found liable and ordered to pay the complainant KES 500,000 as compensation for the use of her image for commercial purposes without express consent. Dated 25 August 2025.
