The facts

Two complainants alleged that the respondent unlawfully posted their images on the Facebook pages Buyer Beware Kenya and Kitengela Residents without their consent. The ODPC found their rights to be informed and to consent were infringed, but noted the posts concerned rental and utility arrears the complainants had accrued, and that the respondent took the posts down after the complainants issued a demand letter.

Orders and outcome

The Office declined to award compensation in the circumstances and declined to issue an enforcement notice because the posts had been taken down after the demand letter. The complaint was dismissed. Dated June 2025.
