Two complainants, in consolidated complaints, alleged that Spoton Vacations Limited continuously sent them unsolicited promotional and direct marketing messages even after they objected. The respondent also ignored or absconded a demonstration session scheduled at the ODPC's offices in August 2024, and the Office found this failure to provide assistance impeded its investigations.
Orders and outcome
The respondent was found liable and ordered to compensate the complainants a total of KES 650,000, comprising KES 200,000 for the first complainant and KES 450,000 for the second, and an enforcement notice was issued against it. Dated 26 August 2024.
