Two complainants, in consolidated complaints, alleged that Metropolis Star Lab Kenya Ltd continuously sent them unsolicited promotional and direct marketing messages through WhatsApp even after they objected. The respondent called the compensation amounts requested exorbitant. The ODPC found it violated the complainants' right to object to processing of their personal data.
Orders and outcome
The respondent was found liable, directed to compensate the complainants a total of KES 500,000, being KES 250,000 for each complainant, and an enforcement notice was issued against it. Dated 6 September 2024.
