Isaya Lemerketo v The Kenya School Of Law
Resolved between the parties. ODPC, 17 July 2023.
The facts
The complainant alleged the Kenya School of Law published his images, including in physically distributed materials, without his authorisation and although he had never been the School's ambassador. The Office found his rights were violated because he was not informed, but noted the School resolved the complaint within 24 hours by pulling down the images.
Orders and outcome
The Office declined to award compensation because the respondent took swift action to remedy the breach, declined the constitutional declaration sought as a preserve of the courts, found prosecution inapplicable, and closed the complaint as resolved. Dated July 2023.
