Two consolidated complaints against Sure Cred Capital Limited, trading as Yescash, a digital credit provider. The complainants were bombarded with texts and calls pressuring them to get the respondent's loanees to repay loans, without ever consenting to be listed as emergency contacts, and the respondent provided no proof of such consent. The first complainant objected to further processing but the respondent ignored the request and kept calling and messaging him.
Orders and outcome
The respondent was found liable, an enforcement notice was issued, and it was ordered to pay the first complainant Kenya Shillings five hundred and fifty thousand (KES 550,000) and the second complainant Kenya Shillings three hundred thousand (KES 300,000) as compensation. Dated December 2023.
