The facts

The complainant challenged the bank's disclosure to executors of the details of accounts held in the name of Mrs. Sudha Shah, details which contained the complainant's name. The ODPC found the disclosure to the executors was lawful and that the complainant did not sufficiently make out his allegations against the respondent.

Orders and outcome

The complaint was dismissed as lacking merit, with no basis for compensation orders. Parties have the right to appeal to the High Court of Kenya. Dated December 2023.
