The facts
The complainant alleged One Acre Fund infringed his right to privacy by sending him unwarranted messages and making unnecessary calls demanding repayment of a loan he never took. The matter was resolved between the parties and marked as closed. The Office noted that a certificate of registration is not proof of compliance with the Act, and that the respondent, registered only as a data controller, should also register as a data processor since it processes its clients' personal data.

The complaint was marked resolved and closed, with the right of appeal to the High Court of Kenya. Dated July 2023.
