Koros Kiprotich v Higher Education Loans Board
Complaint upheld; enforcement notice conditional. ODPC, 2 August 2023.
The facts
The complainant alleged the Higher Education Loans Board failed to update his loan repayment information, so credit reference bureaus still showed his HELB account in default even after he resumed repayment. HELB said it had updated his status with Metropol and TransUnion and regretted its inordinate delay, but the complainant's evidence showed the default status persisted. The Office found his right to rectification of personal data violated.
Orders and outcome
The respondent was directed to rectify and update its records so that the complainant's personal data shared with third parties is accurate, within seven days, failing which an enforcement notice would be issued. Dated August 2023.
