The facts
The complainant alleged that an agent of Lendplus, a product of Aventus Group, bombarded his phone with persistent calls seeking the whereabouts of one of its clients, to the point that he could not use his phone and had to switch it off. The Office found the respondent collected his personal data indirectly without qualifying for any legal exemption and infringed his rights as a data subject.
Orders and outcome
The respondent was found liable and an enforcement notice was ordered to issue against it. The prayer for compensation was denied because the complainant did not demonstrate any financial or other loss. Dated September 2023.
