Summary

The High Court of Kenya declared that Worldcoin's collection of Kenyans' biometric data through the Orb device, run by Tools for Humanity, contravened Article 31 of the Constitution and the Data Protection Act 2019. The court granted judicial review orders against the operation and upheld the ODPC's 2023 enforcement action, in the most significant Kenyan court decision on data protection to date.
