The complainant wrote to Gabon's data protection authority in February 2024 after modifications were made to her CNAMGS health-insurance account and a duplicate insured card was issued without her consent, in the context of an identity-usurpation dispute before the courts. The APDPVP heard both parties, declared itself incompetent on the identity-usurpation limb and referred the complainant to the courts, but found the account changes were processing carried out without the consent required of a controller.
Orders and outcome
A public warning was pronounced against the Caisse Nationale d'Assurance Maladie et de Garantie Sociale, doubled with an immediate formal notice obliging CNAMGS to let the complainant exercise her right of access to her insured account. The deliberation is appealable to the Conseil d'Etat within two months and was ordered published in the Journal Officiel. Deliberation of 25 February 2025, signed at Libreville on 26 February 2025.
