The Autorite de Protection found that the Ministry of Technical Education, Vocational Training and Apprenticeship and Kaydan Groupe, as controller and processor, had processed applicants' personal data without meeting the law's conformity and authorisation requirements, and pronounced against both entities jointly after the breaches were observed.
Orders and outcome
The Autorite de Protection issued a joint warning for non-compliance with the data protection law, a formal notice to cease the observed breaches immediately on receipt of the decision, a formal notice to begin their conformity process within sixty days, and a formal notice requiring each to designate its data protection correspondent. Dated 16 January 2024.
