The facts
Acting on reports about the Yango ride-hailing application, the Autorite de Protection met representatives of Yango CIV LLC on 26 June 2023, who confirmed that the app records passengers' telephone conversations aboard vehicles, citing driver security as the purpose. The Autorite found the recordings unlawful, since processing involving telephone-number identifiers requires its prior authorisation, and found that the privacy policy available on the application did not respect data subjects' rights, notably the right to object to the recording.
Orders and outcome
The Autorite de Protection issued a warning for the unlawful recording of passengers' conversations, a formal notice to disable the conversation-recording feature immediately and until further notice, and a further warning for non-compliance with its statutory obligations. It also ordered the locking and immediate deletion of customers' audio recordings so they are no longer accessible, and required the company to designate its data protection correspondent within seven days.
