The facts
The APD announced that Africell, an electronic communications operator, processed its customers' personal data without notifying the regulator and obtaining its prior authorisation. The categories collected included names, telephone numbers, addresses, sex, age, interests, credit and debit card details and other banking and payment information, location data, call times and identification documents. The Council noted mitigating circumstances: the operator's immediate willingness to conform to the law, no record of prior data protection infringements, no economic advantage taken from the situation, and prompt cooperation with the APD in providing the information required.
Orders and outcome
The APD fined Africell 150 thousand US dollars in national-currency equivalent, noting that failure to notify the regulator is punishable by a fine of up to USD 450,000 in national-currency equivalent. The archived announcement carries no decision date on its face.
